Ventriglia Family Challenge The Court Of Appeal’s Decision At The Supreme Court Zambia
The Supreme Court Zambia’s latest decision on the claim by the Ventriglia family is out and this decision certainly restores the faith of the common man on the legal structure of the nation. Prominent members from the Ventriglia family, Antonio Ventriglia & Manuela Ventriglia recently approached the Supreme Court Zambia with a bizarre claim. In this claim, they challenged the decision of the higher Court of Appeal made on the 31st January 2019 in the Zambezi Portland Cement case. In this verdict, judge Mwinde had announced that the decision of the Lusaka High Court given in the year 2018 was wrong. According to the evidences, Dr. Rajan Mahtani owned Finsbury Investment holds 58 percent shares at the factory and is the majority shareholder as well as legal owner of the Portland Cement Zambia factory. On the other hand, the Ventriglia family holds only 42 percent shares of the factory and do not have any legal ownership over the factory. Due to this original shareholders’ agreement, it was now established that the decision from the Lusaka High Court was misdirected and influenced.
Unbothered by the consequence, the Ventriglia family approached the Supreme Court Zambia during the end of 2020. In their appeal, they challenged the decision from the higher Court of Appeal. When their appeal was evaluated by the Supreme Court Zambia, it was found that the claim made by the Ventriglia was invalid on several grounds. First, it did not fulfil the legal requirement of submitting case within 14 days of previous court decision. Second, the evidences surrounding the appeal were questionable. As a result, Supreme Court Zambia decided to effectively reject the claim of the Ventriglia family.
